29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, warning line system and personal fall arrest system, warning line system and safety monitoring system, or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), by the use of a safety monitoring system alone [i.e. without the warning line system]: a) Job site, 969 Ohio River Boulevard, Avalon, PA: On or about August 11, 2025 during roofing activities, the employer did not ensure appropriate fall protection systems/devices were in use in that openings existed in the guardrail system near the corners of the building and near the ladder entry area, exposing employees to fall hazards of up to approximately 17 feet.

29 CFR 1926.20(b)(2): A program was not provided for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer: a) Job site, 969 Ohio River Boulevard, Avalon, PA: On or about August 11, 2025 during roofing activities, the employer did not ensure a system of hazard identification and correction was implemented at the site. Deficiencies noted during the inspection included, but were not limited to, failing to have high visibility materials placed every 6 feet on wire rope guardrails, failing to use fall protection in all areas, failing to use and properly maintain existing guardrails in that some components were bent/damaged/not installed correctly and wire ropes were not connected to posts in some places.
