29 CFR 1926.300(b)(1): Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use:  a) Worksite at 129 Toddy Drive, East Earl, PA 17519: On or about August 14, 2025, an employee was cutting hardscape paver stones with a handheld grinder (Milwaukee M18 FUEL lithium-ion grinder) and was exposed to hazards involving potential flying debris and broken wheel fragments from the lack of a guard.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) Worksite at 129 Toddy Drive, East Earl, PA 17519: On or about August 14, 2025, an employee was exposed to respirable crystalline silica from cutting hardscape paver stones with a handheld grinder (Milwaukee M18 FUEL lithium-ion grinder) outdoors without an integrated water delivery system that continuously fed water to the grinding surface or a commercially available shroud and dust collection system.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  a) Worksite at 129 Toddy Drive, East Earl, PA 17519: On or about August 14, 2025, an employee was exposed to respirable crystalline silica from cutting hardscape paver stones with a handheld grinder (Milwaukee M18 FUEL lithium-ion grinder) outdoors without an integrated water delivery system that continuously fed water to the grinding surface or a commercially available shroud and dust collection system and the employer had not conducted an exposure assessment.  Abatement certification and documentation required within 10 days after abatement date.
