29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Worksite: 663 Lakeway Drive, Babylon, New York 11703 - Employees were not protected from falling while installing siding on a residential home from a first floor roof approximately 9 feet above the ground below; on or about 8/12/25 a) Worksite: 663 Lakeway Drive, Babylon, New York 11703 - An employee was not protected from falling while installing siding on a residential home from a second floor roof approximately 17 feet above the ground below; on or about 8/12/25 Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed: a) Worksite: 663 Lakeway Drive, Babylon, New York 11703 - An employee was using an 8 foot A-Frame ladder in the closed position on the first floor pitched roof of a two story residential home to install siding, on or about 8/12/25. b) Worksite: 663 Lakeway Drive, Babylon, New York 11703 - An employee was using a 4 foot A-Frame ladder on the first floor pitched roof of a two story residential home to install siding, on or about 8/12/25. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
