29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a.  On or about August 14, 2025, at the above addressed work site, employees operating powered industrial trucks (i.e. forklifts, reach trucks, and/or electric pallet jacks) had not been trained and evaluated to ensure competency in the operation of the equipment, thereby exposing employees to struck-by and crush-by hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a.  On or about August 14, 2025, the employer did not develop and implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:  1) Requirement for labeling of containers of hazardous chemicals; 2) Safety data sheet availability; 3) Training of employees; 4) A complete list of hazardous chemicals known to be present in the workplace; 5) Methods to inform employees of the hazards on non-routine tasks; and 6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system and any precautionary measures to protect employees.  Employees were required to work with chemicals and exposed to hazardous materials such as but not limited to Sunnyside denatured alcohol.

On or about August 15, 2025, at the above-mentioned workplace, the employer failed to verify that the required workplace hazard assessment had been performed through a written certification that identified the workplace evaluated, the person certifying that the evaluation had been performed, the date(s) of the hazard assessment, and which identified the documents as a certification of hazard assessment.

On or about August 14, 2025, at the above-mentioned location, the employer failed to require employees to utilize the required eye protection (tight fitting safety goggles) when working with hazardous chemicals such as, but not limited to, Sunnyside denatured alcohol.
