29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  a) New residential construction located on 3950 Haven Way, Cumming, GA 30028: On or about 08/18/2025, the employer exposed employees to fall hazards of up to 13-feet,  to the lower ground level, in that a ladder or other safe means of access was not provided.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) New residential construction located on 3950 Haven Way, Cumming, GA 30028, Roof: On or about 08/18/2025, the employer exposed employees to falls of over 9 feet, 5 inches while working from a scaffold plank on the roof,  in that a fall protection system was not provided while engaged in masonry activities.  b) New residential construction located on 3950 Haven Way, Cumming, GA 30028, Scaffold: Employees performing masonry work were exposed to a fall hazard of approximately 13 feet, 7 inches while working from a tubular welded scaffold system, in that fall protection was not provided in that mid rails and top rails were missing from the open ends of the scaffold platforms.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  a) New residential construction located on 3950 Haven Way, Cumming, GA 30028: On or about 08/18/2025, the employer failed to inspect all electrical extension cords used to provide power to electric tools, in that a 25 ft. black electrical cord was damaged and exposing the internal insulated energized wires. An inspection of these cords was not performed prior to the shift as these cords were not repaired or removed from service.
