29 CFR 1910.29(b)(1): The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D11 of this section): (a) At the site, located in the double tier flower rooms and mother rooms at 5909 North U.S. Highway 41, Apollo Beach, FL 33572, on or about 8/19/2025, the employer exposed employees to fall hazards of approximately 5 feet 2 inches, in that employees were using Pipp Horticulture Elevated Platform Systems with the top rail not placed 42 inches, plus or minus 3 inches, above the walking-working surface.
