29 CFR  1910.110(f)(6)(ii): LP-gas containers were not in a suitable enclosure or otherwise protected against tampering:  On or about August 20, 2025, the employer did not ensure propane tanks used as fuel for powered industrial trucks (forklifts) were stored in a suitable enclosure or otherwise protected against tampering.  The employer stored approximately nine propane tanks on the ground outside of the building.

29 CFR  1910.178(l)(6): The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  On or about August 20, 2025, the employer did not ensure that forklift training provided to operators was certified to include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.

29 CFR  1910.178(l)(2)(ii):The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  On or about August 20, 2025, the employer did not ensure employees operating powered industrial trucks (forklifts) had successfully completed powered industrial truck training consisting of a combination of formal instruction and practical training prior to being permitted to operate powered industrial trucks in the workplace.  Powered industrial truck operators were only provided with practical training by the employer and did not receive formal instruction prior to being permitted to operate powered industrial trucks in the workplace.

29 CFR  1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about August 20, 2025 the employer did not ensure that all employees were provided effective information and training on hazardous chemicals in their work area such as liquified petroleum gas (propane), prior to performing  propane tank exchange operations on forklifts.
