29 CFR  1910.213(h)(1):The upper hood shall completely enclose the upper portion of the blade down to a point that will include the end of the saw arbor. The upper hood shall be constructed in such a manner and of such material that it will protect the operator from flying splinters, broken saw teeth, etc., and will deflect sawdust away from the operator. The sides of the lower exposed portion of the blade shall be guarded to the full diameter of the blade by a device that will automatically adjust itself to the thickness of the stock and remain in contact with stock being cut to give maximum protection possible for the operation being performed.  a. On or before July 30, 2025, the employer did not ensure that the lower portion of the blade of the 16" Dewalt radial arm saw, Serial #6523001, was guarded resulting in an employee's fingers being amputated while engaging in cutting operations.

Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  a. On or about July 30, 2025, the employer did not report a workplace amputation injury to OSHA within 24 hours.  The employer reported the injury on August 13, 2025.
