29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  On or about August 20, 2025, the employer did not develop, implement and maintain a written Hazard Communications Program, exposing employees to hazardous chemicals such as Silica.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about August 20, 2025, employees were not wearing safety glasses while dry cutting concrete paving stones, exposing employees to struck-by hazards.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.303(b)(1): Grinding machines shall be equipped with safety guards in conformance with the requirements of American National Standards Institute, B7.1-1970, Safety Code for the Use, Care and Protection of Abrasive Wheels, and paragraph (d) of this section.  On or about August 20, 2025, employees used a hand held grinder without the use of a safety guard, exposing employees to cuts and abrasions.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  On or about August 20, 2025, the employer did not implement engineering controls, work practices, and respiratory protection to reduce Silica exposures to employees  dry cutting concrete paving stones, exposing employees respirable Silica dust.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
