29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a) 206 Industrial Park Rd, Belington, WV 26250: On August 20, 2025, a sawmill operator was exposed to occupational noise at 361.1% of the permissible daily noise exposure (eight hour time weighted average of 85 dBA at the 80 dB criterion level) during the 474 minute sampling period. For a full eight hour shift this would be equivalent to an average sound level of 99.2 dBA. The employer did not administer a continuing, effective hearing conservation program to protect employees from hearing loss  (b) 206 Industrial Park Rd, Belington, WV 26250: On August 20, 2025, a sawmill operator was exposed to occupational noise at 309.6% of the permissible daily noise exposure (eight hour time weighted average of 85 dBA at the 80 dB criterion level) during the 477 minute sampling period. For a full eight hour shift this would be equivalent to an average sound level of 98.1 dBA. The employer did not administer a continuing, effective hearing conservation program to protect employees from hearing loss.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
