29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart: a)Lidel Construction Company, Inc at 1715 Riley Street, Rapid City, SD 57701: On or about and at times prior to August 20, 2025, the employer did not ensure that employees hand digging around an existing gas line in an excavation greater than five feet in depth were protected from cave-in hazards by allowable configurations for sloping and benching. This condition exposed employees to struck-by and cave-in hazards.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a)Lidel Construction Company, Inc at 1715 Riley Street, Rapid City, SD 57701: On or about and at times prior to August 20, 2025, the employer did not ensure that the material from the spoils piles near the south end on the east side of the trench were prevented from falling or rolling into the excavation by at least 2 feet. This condition exposed employees to cave-in and struck-by hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a)Lidel Construction Company, Inc at 1715 Riley Street, Rapid City, SD 57701: On or about and at times prior to August 20, 2025, the employer did not ensure that inspections of the excavation at the south end of the trench near the gas line, the adjacent areas, and protective systems were made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. This condition exposed the employee to cave-in hazards associated with trench wall failure.
