OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment that were free from recognized hazards likely to cause death or serious physical harm to employees from struck-by hazards while working in and around the palletized racking system due to the following conditions: a) Warehouse: On or about August 21, 2025, employees were exposed to struck-by hazards while working in and around the palletized racking system due to the palletized racking system not having one or more permanent plaques displaying the maximum permissible load limits. b) Warehouse: On or about August 21, 2025, employees were exposed to struck-by hazards while working in and around the palletized racking system due to visibly damaged sections of the palletized racking system were not isolated until repairs were made. c) Warehouse: On or about August 21, 2025, employees were exposed to struck-by hazards while working in and around the palletized racking system due to at least one upright column installed in such a manner that the baseplate was not fully seated onto the floor without appropriate shims that allow the weight to be distributed across the entire baseplate. Abatement certification and documentation are required.
