29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   a) Building 36, Augustus Drive, Middletown NJ: The employer did not ensure that each worker who utilized Pettibone All-Terrain lifts at the worksite had received training which included formal instruction, hands on and an evaluation with a written certification of completion, on or about 08/21/25. On or about 08/21/25 the company owner was operating two Pettibone All-Terrain lifts to deliver sheathing materials to the worksite workers and performing other similar activities with this equipment.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(b)(2): Scaffold platforms and walkways were not at least 18 inches wide:  a- Building 38, Augustus Drive, Middletown NJ :  A worker was injured when falling approximately 88 inches from a job made wooden scaffold's walking/working surface and onto the concrete flooring below. This scaffold's walking and working surface was not at least 18 inches wide, consisting of a single wooden  2 x 6.  This worker was attempting to access a residential structure's second floor from this scaffold.  Condition existed on or about 07/29/25 and noted by the CSHO on 08/21/25.

29 CFR  1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   a -  Building 38, Augustus Drive, Middletown NJ : A worker was injured when falling approximately 88 inches from a job made wooden scaffold's walking/working surface and onto the concrete flooring below. This worker was not trained nor received training by a person qualified in scaffold hazard recognition and did not understand the procedures to control or minimize those hazards.  Condition existed on or about 07/29/25 and noted by the CSHO on 08/21/25 and 12/05/25.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.602(c)(1)(vi): Section 603(e) of American National Standard Institute, B56.1-1969 Safety Standards for Powered Industrial Trucks, as adopted by 29 CFR 1926.602(c)(1)(vi): When a truck was left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, brakes were not set, and the key or connector plug was not removed:  a) Building 36, Middletown NJ: On or about 08/21/25, a Pettibone All-Terrain lift, used to deliver and support a stack of OSB to workers working from a residential structure's second floor, was left unattended with the load engaging means raised and extended, the key left in the ignition, and the brake not set thereby exposing workers to the hazard of being struck by the vehicle or its elevated, supported load.  b) Building 36, Middletown NJ: On or about 08/21/25, a Pettibone All-Terrain lift, was moved to the building and left unattended with the load engaging means raised and extended, the key left in the ignition, and the brake not set thereby exposing workers to the hazard of being struck by the vehicle or its elevated, supported forks.

29 CFR  1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.   a- Building 38, Augustus Drive, Middletown NJ :  A worker was injured when falling approximately 88 inches from a job made scaffold's walking/working surface (consisting of a single wooden  2 x 6) onto the concrete flooring when attempting to access a residential structure's second floor from this scaffold. The worker accessed this scaffold using aladder.  This worker did not receive ladder hazard recognition and minimization training from the employer at the time of and prior to the day of the incident.  Condition existed on or about 07/29/25 and noted by the CSHO on 08/21/25.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
