29 CFR 1910.106(b)(2)(vi)(b):  Where vent pipe outlets for tanks storing Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C), are adjacent to buildings or public ways, they were not located so that the vapors are released at a safe point outside of buildings and horizontally away from closely adjacent walls.   a. The Enviro-Rack Area - On or about August 19, 2025, the 100 gallon gas pumping tank against the metal pole-building was not separated or relief designed to keep flammable relief vapor away from the building resulting in the spread of fire exposing employees to fire and structural collapse struck-by hazards.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1910.106(g)(3)(iv)(d): Class I flammable dispensing unit(s) were not mounted on a concrete island or protected against collision damage by suitable means.   a. The Enviro-Rack Area - On or about August 19, 2025, the 100 gallon gas pumping tank between the building that caught fire and the enviro-rack was not protected against being struck by forklift and other equipment traffic in the area, exposing employees to a fire or explosion hazard.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):  a. The Enviro-Rack Area - On or about August 19, 2025, employees were using the GEHL telehandler all terrain forklift to pick up vehicles to put them onto the Enviro-Rack, the spreader bar that holds fork tines was deformed to the point that it would not sit inside the lock rest which keeps the forks from sliding during operation.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
