OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to physical assaults by patients. Location: Wisconsin Avenue Psychiatric Center, Inc. DBA Psychiatric Institute of Washington 4228 Wisconsin Avenue, NW WASHINGTON, DC 20016 Patient Care Areas. a) On or about, July 29, 2025, and times thereafter, employees, including Nurses, Certified Nursing Assistants, Mental Health Technicians, Nursing Technicians, and Nursing Supervisors were exposed to physical threats and assaults, such as being bitten, punched, kicked, scratched, and other serious physical assault during routine interactions with patients when providing care, performing one-on-one observations, de-escalating patients, and other daily activities. The employer has not implemented adequate measures to protect its employees from this hazard. UHS of Delaware, Inc and TBJ Behavioral was previously cited for a Serious violation of Section 5(a)(1) of the OSHA Act for workplace violence, which was contained in OSHA inspection number 1643969, citation 1, item number 1, and was affirmed as a final order on November 1, 2024, with respect to a workplace located at 6300 Beach Boulevard, Jacksonville, FL 32216. UHS of Delaware, Inc. / Wekiva Springs Center LLC was previously cited for a Serious violation of Section 5(a)(1) of the OSHA Act for workplace violence, which was contained in OSHA inspection number 1635621, citation 1, item number 1, and was affirmed as a final order on November 1, 2024, with respect to a workplace located at 3947 Salisbury Road, Jacksonville, FL 32216. UHS of Westwood Pembroke was previously cited for a Repeat-Serious violation of Section 5(a)(1) of the OSHA Act for workplace violence, which was contained in OSHA inspection number 1182790, citation 1, item number 1, and was affirmed as a final order on June 26, 2023, with respect to a workplace located at 199 Oak Street, Pembroke, MA 02359. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.
