29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: An effective hearing conservation program which included noise monitoring, audiometric testing of employees and training of employees as detailed in the standard was not instituted by International Marble & Granite dba Stone City. a) On or about September 25, 2025, an employee using a an air powered tool to finish granite and marble countertops in the work area was exposed to continuous noise levels at 79.5% of the allowable action level 8-hour time-weighted average sound level of 85 dBA. The equivalent dBA level of 79.5% is approximately 88.3 dBA. The sampling was performed for 507 minutes during one shift.

29 CFR 1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a) On or about September 22, 2025, the employer did not ensure that a written respiratory protection program was established and implemented for those employees required to wear respiratory protection. Employees manufacturing stone countertop, polishing, and grinding operations were exposed to crystalline silica dust approximately 1.1 times the OSHA Permissible Exposure Limit (PEL) of 50 µg/m^3. Employees were required to wear a 3M half-face tight fitting respirators. The respiratory protection program shall include, at a minimum: 1) Procedures for selecting respirators; 2) Medical evaluations; 3) Fit testing; 4) Procedures for proper use in routine and reasonably foreseeable emergency situations; 5) Procedures for cleaning, storing, inspecting, repairing and discarding respirators; 6) Employee training regarding respiratory hazards they are exposed to, proper uses and limitations of respirators; and 7) Procedures for regularly evaluating the effectiveness of the respirator program.

Employees are required to work with granite that contains silica, exposing them to a hazardous materials.
