29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury.  (a) Jobsite: On or about August 26, 2025, employees had previously removed painted exterior siding that was later confirmed to contain 117 ppm inorganic lead. The employer did not provide instruction on identifying lead-containing materials, preventing dust generation, implementing safe work practices, or complying with lead-related requirements. As a result, employees performed work that disturbed lead-positive siding without understanding the associated health hazards or proper protective measures required to prevent or reduce exposure.

29 CFR 1926.62(d)(1)(i): Each employer who had a workplace or operation covered by 29 CFR 1926.62 did not initially determine if any employee was exposed to lead at or above the action level of 30 micrograms per cubic meter of air (30 Î?g/m3) calculated as an 8-hour time-weighted average (TWA).   (a) Worksite: On or about August 26, 2025, the employer did not initially determine whether any employee was exposed to lead at or above the action level of 30 µg/m3, calculated as an 8-hour TWA. Employees were observed removing painted siding that later tested positive for lead, a task reasonably anticipated to generate airborne lead-containing dust. Prior to starting this work, the employer had not conducted personal air monitoring or relied on objective data to assess employee exposure, as required by 29 CFR 1926.62(d)(1)(i).
