OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a fall hazard:  (a) On August 26, 2025, at 9663 87th Avenue South in Ellendale, North Dakota,  an employee was exposed to fall hazards while using a Case CX52C Mini Excavator with a Geith H06-0990-9084 Bucket attachment as a means of access onto an oil separator.  Note: Among other methods, one feasible and acceptable method to correct this hazard would be to follow the operator's manual for the excavator not allow employees to use the bucket as a step.  Ensure employees use a ladder or other safe means to access and egress equipment.
