29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section. With respect to a worksite located at 140 Commerce Drive in Luxemburg, Wisconsin; the employer has failed to certify that the hazardous conditions related to fall hazards in an aerial lift as identified in Citations 1, Item 1, instances (a) and (b) of this inspection issued September 4, 2025 have been corrected including the methods taken to correct the fall hazards.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (§ 1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under § 1926.502(e). a) On or about August 27, 2025, at a worksite located at 140 Commerce Drive in Luxemburg, Wisconsin; an employee was exposed to a fall hazard of approximately 7.5 feet to the ground level while working from a Genie S-40 aerial lift without the use of a full-body harness with a lanyard attached to the manufacturer supplied boom or basket anchor point of the lift. b) On or about August 27, 2025, at a worksite located at 140 Commerce Drive in Luxemburg, Wisconsin; an employee was exposed to a fall hazard of approximately 12 feet to the ground level while working from a Genie S-45 aerial lift without the use of a full-body harness with a lanyard attached to the manufacturer supplied boom or basket anchor point of the lift.
