29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) Jobsite located at 725 W Market Street, West Chester, PA- On or about August 27, 2025, the employer failed to ensure that an inspection of the excavation, adjacent area, and protective system were made by a competent person prior to the start of work for evidence of a situation that could result in possible cave-ins or other hazardous conditions. Employees were performing excavations to install and underground pipe without a designated competent person to inspect the excavation and determine if protective system are needed, thereby exposing employees to cave-in hazards.

Employees were performing excavation to perform underground utility work within the excavation measuring approximately 7 feet deep without the use of shoring or other protective system, thereby exposing employees to cave-in hazards.
