1910.178(l)(3)(i)(L)  Operating limitations; OSH ACT of 1970 Section 5(a)(1) Or 1960.8(a):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees not wearing seatbelt when operating  powered industrial trucks .  a) On or about  July 7, 2025, 1100 Ohio Drive, Southwest Washington, D.C, the employer did not ensure that the operator of a powered industrial truck was wearing the provided restraining device while operating the equipment. The absence of this restraint resulted in the employee being injured and pinned by the overhead guard while attempting to jump off the equipment.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
