29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level: (a) Under-construction residential structure, west side garage roof; On or about August 27, 2025, a worker was not protected from falls while riding on a steel platform attachment placed on the forks of a Pettibone brand model 8044 all-terrain forklift to access and egress the roof at an approximate height of 11-feet above ground-level.

29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the capacity or safe operation of the equipment were made without the manufacturer's written approval, and/or if such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly: (a) Under-construction residential structure, west side garage roof; On or about August 27, 2025, a fabricated steel platform placed on the forks of a Pettibone brand model 8044 all-terrain forklift was used to transport a worker to and from elevated locations and neither the forklift nor platform were identified with capacity ratings, limitations, etc. and/or the attachment was not approved by the manufacturer for such use.
