Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to fall Hazards:    (a) On August 26, 2025, at or near 920 Elk Street in Alexander, North Dakota, an employee was exposed to fall hazards of over 8 feet while installing exterior framing on a single family residential home, while standing in the bucket of a skid steer loader.  Note: Among other methods, one feasible means to correct this hazard would be to follow the manufacturer's recommendations contained within the Operation & Maintenance Manual to not allow any personnel to use the bucket as a work platform.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person:    (a)  On August 26, 2025, at or near 920 Elk Street in Alexander, North Dakota, employees were exposed to crush by hazards while installing exterior sheathing, utilizing a forklift supported shop made wood scaffold platform that had cracked and broken boards and had no means to secure it to the forks to prevent it from being dislodged.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:    (a) On August 26, 2025, at or near 920 Elk Street in Alexander, North Dakota, employees were exposed to fall hazards of over 12 feet while installing exterior sheathing while elevated on a forklift supported scaffold latform which was not equipped with fall protection systems.
