29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation:  On or about August 28, 2025, employees engaged in oversight and management of a commercial construction site located at 109 Scott Road, Papillion, Nebraska were exposed to fall hazards while working from a scaffold. Employees accessed a scaffold where the upright baseplates did not bear completely on the mudsill, rested and/or rested on the mudsill at an angle.

29 CFR 1926.451(f)(4): Part(s) of a scaffold that were damaged or weakened, such that the scaffold's strength was less than that required by paragraph (a) of this section, were not immediately repaired, replaced, braced to meet those provisions, nor removed from service until repaired:  On or about August 28, 2025, employees engaged in oversight and management of a commercial construction site located at 109 Scott Road, Papillion, Nebraska were exposed to fall and struck-by hazards in excess of 10 feet while working from a fabricated frame scaffold.  Specifically, the employer failed to stop the use of the scaffolding system until deficiencies were corrected.  Instances of deficiencies include but are not limited to:   i.	Bent uprights on the scaffold frames that prevent scaffolding from being level and plumb ii.	Bent base plates that will not sit flush on mud sills iii.	Scaffold cross braces that were not secured with connecting pins compromises system integrity

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:   On or about August 28, 2025,  employees engaged in oversight and management of a commercial construction site located at 109 Scott Road, Papillion, Nebraska were exposed to fall hazards approximately 13 feet 9 inches while working from a fabricated frame scaffold. Instances of exposure include but are not limited to:  i.	Employee standing near the unguarded ends of the second tier of the scaffold, 13 feet 9 inches above the working surface below.  ii.	Employee walking/using the entire second tier of the scaffold while inspecting the project in which the employer has only installed one set of cross braces in lieu of the required top and mid rail combination, 13 feet 9 inches above the working surface below.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall:  On or about August 30, 2025, employees engaged in oversight and management of a commercial construction site located at 109 Scott Road, Papillion, Nebraska were exposed to struck-by hazards while working near or around a frame scaffold, in that employees were not protected against objects falling from unguarded scaffold platforms greater than approximately 13 feet from the next lower level.

29 CFR 1926.452(c)(2): All brace connections were not secured:  On or about August 28, 2025,  employees engaged in oversight and management of a commercial construction site located at 109 Scott Road, Papillion, Nebraska were exposed to potential structural collapse conditions which creating struck-by and fall hazards while working on and around the fabricated frame scaffold in that the employer failed to ensure all required bracing was secured in accordance with manufacturers recommendations.  Instances include but are not limited to:  i.	Vertical cross braces that are resting on pins but not secured using pin clamp ii.	Vertical cross braces are not secured to each other at the crossing point to prevent displacement iii.	Missing horizontal cross braces at the base of each scaffold set.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about August 28, 2025, employees engaged in oversight and management of a commercial construction site located at 109 Scott Road, Papillion, Nebraska were exposed to fall hazards while accessing and egressing a fabricated frame scaffold in that the employer failed to provide a ladder or other means of acceptable access/egress before employees began working from the system. Employees were accessing the scaffold system by climbing up the scaffold frame ends as means of getting to and from each tier of the system.    Argen Contracting, Inc. doing business as Van Tassel-Proctor, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1703087, citation number 1, item number 2, and was affirmed as final order on November 29, 2023, with respect to a worksite located at 1434 North Burnside, Gonzales, Louisiana.
