29 CFR 1910.23(c)(4): The employer did not ensure that ladders that are used only on stable and level surfaces unless they are secured or stabilized to prevent accidental displacement. a) 132 Joysan Terrance, Freehold, NJ: An employee was exposed to a fall hazard while using a Hasegawa Tripod Ladder. The employer did not provide all the equipment needed for the safe use of the ladder. Specifically, the required rubber foot pads for hard surfaces were missing, resulting in an unstable ladder. Consequently, the employee fell from an approximate height of fourteen feet and sustained fatal injuries. Observed on or about 08/30/25. Reference Hasegawa Tripod Ladder Safety and User Guide - Page 4: "If using on a hard surface or indoors, the rubber accessory kit MUST BE INSTALLED on the ladder feet." - Page 5: "The rubber cover should be installed and used whenever a foot is on a hard surface, such as asphalt, or indoors." NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. a) 132 Joysan Terrance, Freehold, NJ: The employer failed to report a hospitalization within the required twenty-four hours. An employee sustained injuries requiring hospitalization at approximately 08:30 on 08/03/2025. On 09/04/2025, OSHA MAO was notified of the employee's passing the night prior. Observed on or about 08/30/2025. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
