OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by wood building components in the event of structural collapse:  (a) Under-construction commercial building; On or about September 2, 2025, adequate bracing was not provided for the trusses and walls of the newly constructed 150-foot long by 80-foot wide wood framed commercial building while 80-foot long metal plate connected wood trusses were being installed atop 18 foot tall wooden framed walls.  At the time of and before the truss collapsed, employees were exposed to hazards of being struck by building components while guiding trusses into position with tag line ropes, while working from lifts (aerial, scissors) to install trusses, and while walking in the trusses to install a few temporary braces.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  (a) Under-construction commercial building; On or about September 2, 2025, while installing and bracing roof trusses, employees worked from bottom chords and/or within truss webbing at approximately 18 feet or more above ground level without a fall?protection system in place, exposing them to fall hazards.
