First Line Coatings, Inc, Dock Area, On 9/4/25 and times prior thereto: An employee was operating the Yale LP Forklift Serial No. 09042495021352-05  Model No. GLP030BFNUAE084 to move the Presto PowerStak Model No. PPS1100-62-CB Serial No. V185980-ST2212051 from Dock 10B to 10A without utilizing the operator restraint system (i.e.-seatbelt).  The employee jumped off of the Yale LP Forklift  into Dock 10A.  The forklift landed on the employee resulting in fatal injuries.    ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

First Line Coatings, Inc, Dock Area, On 9/4/25 and times prior thereto rigging equipment including but not limited to synthetic straps were placed on the forks of the Yale LP Forklift Serial No. 09042495021352-05  Model No. GLP030BFNUAE084 .  "Free rigging" was being used to lower the Presto PowerStak Model No. PPS1100-62-CB Serial No. V185980-ST2212051 from Dock 10B to 10A.  The employer had not received prior written permission from the forklift manufacturer to conduct free rigging.
