OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were operating a forklift without using a seatbelt which exposed employees to potential crushing and struck-by hazards:  A.) First Line Coatings, Inc, Dock Area, On 9/4/25 and times prior thereto: An employee was operating the Yale LP Forklift Serial No. 09042495021352-05  Model No. GLP030BFNUAE084 to move the Presto PowerStak Model No. PPS1100-62-CB Serial No. V185980-ST2212051 from Dock 10B to 10A without utilizing the operator restraint system (i.e.-seatbelt).  The employee jumped off of the Yale LP Forklift  into Dock 10A.  The forklift landed on the employee resulting in fatal injuries.    ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

29 CFR  1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:   A.) First Line Coatings, Inc, Dock Area, On 9/4/25 and times prior thereto: Fork extender attachments were being used with sit down forklifts including, but not limited to, Yale LP Forklift Serial No. 09042495021352-05  Model No. GLP030BFNUAE084 .  Fork Extenders were being used in conjunction with "free rigging" to lower the Presto PowerStak Model No. PPS1100-62-CB Serial No. V185980-ST2212051 from Dock 10B to 10A.  The employer had not received prior written permission from the forklift manufacturer to use the attachment.  B.) First Line Coatings, Inc, Dock Area, On 9/4/25 and times prior thereto rigging equipment including but not limited to synthetic straps were placed on the forks of the Yale LP Forklift Serial No. 09042495021352-05  Model No. GLP030BFNUAE084 .  "Free rigging" was being used to lower the Presto PowerStak Model No. PPS1100-62-CB Serial No. V185980-ST2212051 from Dock 10B to 10A.  The employer had not received prior written permission from the forklift manufacturer to conduct free rigging. First Line Coatings, Inc, Dock Area, On 9/4/25 and times prior thereto: Fork extender attachments were being used with sit down forklifts including, but not limited to, Yale LP Forklift Serial No. 09042495021352-05  Model No. GLP030BFNUAE084. First Line Coatings, Inc, Dock Area, On 9/4/25 and times prior thereto: An employee was operating the Yale LP Forklift Serial No. 09042495021352-05  Model No. GLP030BFNUAE084 to move Presto PowerStak Model No. PPS1100-62-CB Serial No. V185980-ST2212051 from Dock 10B to 10A.  A safe distance was not maintained between the forklift and the edge of Dock 10B.  The forklift went over the edge of the docks and landed on the employee resulting in fatal injuries. First Line Coatings, Inc, Dock Area, On 9/4/25 and times prior thereto: Synthetic Web slings were placed on the forks of the Yale LP Forklift Serial 09042495021352-05 to lower the Presto PowerStak Model # PPS1100-62-CB from Dock 10B to 10A. Rated capacity information was worn off or unable to be read on slings in the area.
