OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards:   On or about and at times prior to September 5, 2025, at 4800 West Electric Avenue in West Milwaukee, Wisconsin, employees were exposed to crushing hazards when loading/unloading and  working around commercial pallet racking, used to store roofing materials, located inside the main building warehouse which had damaged legs/uprights, cross members, and footings; in that:  (a) In the racking aisle (designated as 4200), the upright sustained damage that resulted in deflection of approximately 5 degrees from plumb and a clockwise deflection of more than 10 degrees;  (b) In the racking aisle (Norandex storages area), the upright sustained damage that resulted in deflection of approximately 4 inches on lower bracing member and inward deflection of approximately 5 degrees on the footing, which resulted in damage to the securing bolts;  (c) In the racking aisle (Lead Roof Flashing storage area), the upright sustained damage that resulted in deflection of approximately 8 degrees from plumb;  (d) In the racking aisle (rolls of metal flashing storage location), the upright sustained damage that resulted in deflection of approximately 6 degrees from plumb;  (e) In the racking aisle (roof vent storage area), the upright sustained damage that resulted in deflection of approximately 15 degrees from plumb and damage to the footings resulting in disconnection to the anchoring;  (f) In the racking aisle (Certain Teed ridge vent storage area), the upright sustained damage that resulted in deflection of approximately 4 degrees from plumb;  (g) In the racking aisle (Certain Teed insulation storage area), the upright sustained damage that resulted in deflection of approximately 7 degrees from plumb;  (h) In the racking aisle (GAF Tiger Paper storage area), the upright sustained damage that resulted in deflection of approximately 8 degrees from plumb;  (i) In the racking aisle (Norandex storage area), the upright sustained damage that resulted in deflection of approximately 10 degrees from plumb;  (j) In the racking aisle (Vycor  adhesive roll storage area), the upright sustained damage that resulted in the lower bracing welding disconnection and clockwise rotation of the footing of approximately 4 degrees;  (k) In the racking aisle (Tarco tar paper roll storage area), the upright  bracing sustained damage that resulted in deflection of approximately 0.57 inches, and;  (l) In the racking aisle (AV exhaust Vent storage area), the upright sustained damage that resulted in deflection of approximately 16 degrees from plumb.
