29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  At the recycling facility located at 1201 E 12th Street in Lamar, Missouri 64759, on September 4, 2025, and at times prior: The employer did not establish a Hearing Conservation Program. Employees were exposed to hearing loss from continuous noise levels higher than 85 dBA for the Action Level and 90 dBA for the PEL. Employees sampling survey showed results over the Action Level at 90.7 dBA and 91.4 dBA.

29 CFR  1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  At the recycling facility located at 1201 E 12th Street in Lamar, Missouri 64759, on September 4, 2025, and at times prior: Employees were exposed to respiratory hazards in the form of asthma, lung disease, COPD, and other serious diseases including cancer, from inhalation of dust particles (respirable dust) while performing sorting and recycling of landfill waste.  An employee's 8-hour TWA sampling results showed an overexposure to Particulates Not Otherwise Regulated at 9.6924 mg/m3, almost twice the 	PEL 5 mg/m3. The employer had not develop and implement a written respiratory program.

At the recycling facility located at 1201 E 12th Street in Lamar, Missouri 64759, on September 4, 2025, and at times prior: Employees were exposed to struck and crushed by hazards such as pedestrian collisions, improper operation of the equipment, falling loads, and rollovers amongst others. The employer did not ensure that each operator had successfully completed the training required by the forklift standard prior to permitting employees to operate the powered industrial trucks in the facility.

The employer had not developed or implemented a written hazard communication program to train employees in the safety and health hazards, precautions, emergency response and safety data sheet information for all the chemicals and processes used in the workplace.
