General-duty citation text
29 CFR 1910.37(a)(3): Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level. Home Depot U.S.A. Inc. Store #6844 East Elmhurst, NY. Employees performing job duties such as, but not limited to restocking shelves, store maintenance, and customer service, were exposed to a delay in exiting the building due to an accumulation of snow preventing the emergency exit doors from opening in the direction of egress. The employer had not initiated a snow removal process along outside exit routes; on or about 1/30/2026. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
