29 CFR  1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a) On or about July 9, 2025, the employer did not protect employees from a fall of approximately 6 feet while working on an elevated work platform, at or near loading dock 3. Employees utilized a harness, as a personal fall arrest system, while tied off to an inadequate guardrail system that was loose and unsecure at the base plate.  b) On or about September 8, 2025, the employer did not protect employees from a fall of approximately 4 feet while working at or near loading dock 6. Forklifts and pedestrians transit the area which is not marked with a chain or other warning device when the dock is not in use.

29 CFR  1910.140(c)(13)(i): Anchorages were not capable of supporting at least 5000 pounds (22.2 kN) for each employee attached:  On or about July 9, 2025, the employer permitted employees to use a homemade platform attachment in conjunction with the Caterpillar powered industrial truck (Model M2C400, S/N AT9040523) to work from elevations such as during dock repairs and used the guardrail as an anchorage point as part of the personal fall protection system.  Bolts were missing from the base of the guardrail system and the guardrail swayed back and forth.

The lift truck was available for use and had the key in the ignition.
