29 CFR  1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:   a) 3rd Floor - Patient Drug Administration Area:    On or about 9/9/2025 and continuing:    The employer did not have employees use appropriate personal protective equipment (e.g. gowns or equivalent) to prevent bodily contact with hazardous drugs including but not limited to cyclophosphamide (carcinogen, mutagen, teratogen)  etoposide (carcinogen, mutagen, teratogen) doxorubicin (carcinogen, mutagen, teratogen),  Velcade [bortezomib] - (teratogen)], during administration to patients.   In addition to abatement certification, the employer is required to submit abatement documentation for this item.  Failure to comply will result in additional penalty of $ 1,000.00 as per 29 CFR 1903.19

29 CFR  1910.132(d)(1)(i): The employer did not select and have each affected employee use, the types of personal protective equipment that would protect the affected employee(s) from the hazards identified in the hazard assessment:   a) 3rd Floor - Patient Drug Administration Area:    On or about 9/9/2025 and continuing:    The employer did not have employees use gowns when administering antineoplastic drugs (e.g., cyclophosphamide, etoposide,  doxorubicin, etc.) to patients when the employer had identified in the personal protective equipment hazard assessment that this  personal protective equipment was required to be worn when performing these procedures.   In addition to abatement certification, the employer is required to submit abatement documentation for this item.  Failure to comply will result in additional penalty of $ 1,000.00 as per 29 CFR 1903.19

29 CFR  1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   a) 3rd Floor - Mixing Room:   On or about 9/9/25 and continuing:   Employees handled, mixed and prepared hazardous chemicals (e.g., hazardous drugs) including but not limited to  cyclophosphamide (carcinogen, mutagen, teratogen), etoposide (carcinogen, mutagen, teratogen),  doxorubicin (carcinogen, mutagen, teratogenic),  Velcade [bortezomib] - (teratogen),  etc. as well as used hazardous chemicals including but not limited to Peridox RTU (hydrogen peroxide, peroxyacetic acid), for cleaning/chemical deactivation on various surfaces (e.g., including the biological safety cabinet and other surfaces) and the employer did not develop and implement a written hazard communication program.  b) 3rd Floor - Hazardous Drug Administration Area for Patients:    On or about 9/9/25 and continuing:   Employees handled and administered hazardous chemicals (e.g.,  hazardous drugs) including but not limited to  cyclophosphamide (carcinogen, mutagen, teratogen), etoposide (carcinogen, mutagen, teratogen),  doxorubicin (carcinogen, mutagen, teratogen),  Velcade [bortezomib - (teratogen],  etc. and handled/used hazardous chemicals (e.g., Sani -Cloth Germicidal Wipes) for cleaning various surfaces and the employer did not develop and implement a written hazard communication program.
