29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to the work environment to control or eliminate hazards or other exposure to illness or injury:  Worksite located at 84-88 Beacon Avenue, Jersey City, NJ  a) The employer did not instruct employees in the recognition and avoidance of unsafe conditions and regulations while performing construction footing and formwork activities in an unprotected excavation and exposed to cave-in hazards and struck-by hazards from soil pile and equipment placed at the edge of the excavation. Additionally, employees were exposed to impalement hazards from uncapped rebar in the excavation.  b) The employer did not instruct employees in the recognition and avoidance of unsafe conditions and regulations for an employee operating an excavator exposing employees to struck-by and crushing hazards.  Violation occurred on or about 09/10/2025

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  a) Worksite located at 84-88 Beacon Avenue, Jersey City, NJ  A competent person did not conduct daily inspections of the 6 foot deep excavation.   Employees were performing formwork activities in the excavation and exposed to cave in hazards due to a lack of protective systems and struck by hazards from concrete blocks, 2x4s and spoil pile and gravel within 2 feet of excavation.  Violation occurred on or about 09/10/2025
