OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to respiratory hazards. (a) On September 6, 2025, and at times prior at or near Borstad 34-10H-A about 4 miles north of Tioga, North Dakota, employees performing tank gauging and other activities at oil and gas well sites were exposed to hazardous chemicals such as petroleum vapors, to include but not limited to hydrocarbon and/or volatile organic compounds. Abatement Note: Among other methods, one feasible and acceptable abatement method to control this hazard would be to ensure that calibrated and functional multi-gas monitors, or other direct reading equipment are provided and required to be used when performing manual tank gauging and other activities on oil & gas well sites.

29 CFR 1910.1200(h)(3)(i): The employee training did not include the methods and observations used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.): (a) On September 6, 2025, and at times prior at or near Borstad 34-10H-A about 4 miles north of Tioga, North Dakota, employees performing tank gauging and other activities at oil and gas well sites were not trained on the methods used to detect the presence or release of hazardous chemicals such as petroleum vapors, to include but not limited to hydrocarbon and/or volatile organic compounds.
