29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) On or about September 12, 2025, at 5271 W Taft Rd, Syracuse NY 13212: An employee was installing roofing material on an estimated 6:12 pitch roof with an approximate ground to eave height of 15 feet without fall protection of any kind exposing the employee to a fall hazard greater than 6 feet.   b) On or about September 12, 2025, at 5271 W Taft Rd, Syracuse NY 13212: An employee was observed on the estimated 4:12 pitch porch roof  with an approximate ground to eave height of 9 feet without fall protection of any kind exposing  the employee to a fall hazard greater than 6 feet.

29 CFR  1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  a) On or about September 12, 2025, at 5271 W Taft Rd, Syracuse NY 13212: An employee was installing roofing material on an estimated 6:12 pitch roof with an approximate ground to eave height of 15 feet without fall protection of any kind. Another employee was on the porch roof with an estimated ground to eave height of 9 feet without fall protection. Both employees were exposed to a fall hazard greater than 6 feet, had previously been trained on fall protection, and failed to implement fall protection.  Abatement certification is required.
