29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.   At the jobsite located at 17312 Earnshaw Street, Overland Park, KS, employees engaged in residential roofing activities with the use of pneumatic nail guns were exposed to struck-by hazards, in that eye protection was not utilized.

29 CFR  1926.501(b)(4)(i):Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  At the jobsite located at 17312 Earnshaw Street, Overland Park, KS, employees were working on the floor level around the open stair case that had an opening to a lower level that was greater then 6 feet in depth.

29 CFR  1926.1053(b)(13): The top or top step of a stepladder was used as a step.  At the jobsite located at 17312 Earnshaw Street, Overland Park, KS, employees were utilizing a ladder improperly in that while they were using a gorilla ladder in an A-Frame configuration, the employees utilized the top step  to access/exit from the roof eave.
