29 CFR  1910.1200(e)(1):Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (Construction Reference: 1926.59)  At the temporary jobsite located at 10719 Waterside Ct. Wichita, KS 67205, employees are exposed to chemical hazards. Employees engaged in roofing activities were exposed to dermal, ingestion, and inhalation hazards from exposure to gasoline, tripolymer sealant, and asphalt shingles. The employer had not developed and implemented a hazard communication program.

29 CFR  1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s): (Construction Reference: 1926.59)  At the temporary jobsite located at 10719 Waterside Ct. Wichita, KS 67205, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheets (SDSs) for gasoline, tripolymer sealant, and asphalt shingles at the job site. The chemical hazards associated with these chemicals include: skin and eye irritation, drowsiness and/or dizziness, throat, lung and respiratory tract irritation, silicosis/siderosis, vomiting and/or diarrhea, suspected of causing cancer and may be fatal if swallowed and enters airways.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)  At the temporary jobsite located at 10719 Waterside Ct. Wichita, KS 67205, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided training on the chemical hazards of gasoline, tripolymer sealant, and asphalt shingles. The chemical hazards associated with these chemicals include: skin and eye irritation, drowsiness and/or dizziness, throat, lung and respiratory tract irritation, silicosis/siderosis, vomiting and/or diarrhea, suspected of causing cancer and may be fatal if swallowed and enters airways. Additionally, gasoline can act as a fueling agent due to its extreme flammability as a liquid and vapor.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   At the temporary jobsite located at 10719 Waterside Ct. Wichita, KS 67205, employees engaged in roofing activities on a 6:12 pitched roof were exposed to fall hazards of approximately 9.8 feet from the eave of the roof to the ground below in that fall protection was not utilized.
