29 CFR 1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard")  a)	On or about September 15, 2025, at the above addressed jobsite, the employer allowed employees to use half mask tight fitting respirators during daily duties.  The employer did not provide the employees using respirators with the information contained in "Appendix D" as required by this standard.

29 CFR 1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section:  a. On or about Sept 15, 2025, the employer did not assess employee exposure for silica and respirable crystalline silica. This condition exposed employees to the hazards of respirable crystalline silica and serious silica-related diseases, including but not limited to:  ? Silicosis, an incurable lung disease that can lead to disability and death.  ? Lung cancer.  ? Chronic obstructive pulmonary disease (COPD); and  ? Kidney disease.

29 CFR 1910.1053(f)(2)(i): The employer did not establish and implement a written exposure control plan that contained at least the following elements: a description of the tasks in the workplace that involve exposure to respirable crystalline silica; a description of the engineering controls, work practices, and respiratory protection used to limit employee exposure to respirable crystalline silica for each task; and a description of the housekeeping measures used to limit employee exposure to respirable crystalline silica.   a) On or about September 15, 2025, in the facility, the employer failed to establish and implement a written exposure control plan to protect employees from Respirable Crystalline Silica (RCS).
