29 CFR 1926.451(a)(6):Scaffolds were not designed by a qualified person. a. H & H Custom Homes and Construction at a jobsite located at 13 E. College St, Fredericktown, OH 43019: On or about September 17, 2025 and at times prior, the employer did not ensure a scaffold platform being utilized to lift personnel using a JLG Model G9-43A telehandler rough terrain forklift was designed by a qualified person. Employees were exposed to a fall of over 17 feet when using a work platform without guardrails or any other form of fall protection while performing framing activities as a part of a commercial construction project.

29 CFR 1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied. a. H & H Custom Homes and Construction at a jobsite located at 13 E. College St, Fredericktown, OH 43019: On or about September 17, 2025 and at times prior, the employer permitted employees to work off a work platform that was elevated on the forks by a JLG Model G9-43A telehandler rough terrain forklift without being attached to the forks and/or forklift. By permitting the employee to work off the platform, the employer exposed the employees to a fall hazards of over 17 feet to the ground level.

29 CFR 1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. a. H & H Custom Homes and Construction at a jobsite located at 13 E. College St, Fredericktown, OH 43019: On or about September 17, 2025 and at times prior, employees were working from an elevated platform being supported on the forks of JLG Model G9-43A telehandler rough terrain forklift without any form of fall protection exposing the employees to falls over 17 feet.

As a result, employees were exposed to a fall hazard of over eight feet. b. H & H Custom Homes and Construction at a jobsite located at 13 E. College St, Fredericktown, OH 43019: On or about September 17, 2025, the employer did not ensure that employees performing framing activities were protected from falling from from a structural beam as it was being installed. As a result, employees were exposed to a fall hazard of over 17 feet.
