Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from the release of stored energy: (a) On September 18, 2025, and at times prior, at 101st Valve Set, GPS 48.404333 N ? 102.866472, Tioga, ND 58852, employees were engaged in maintenance activities involving the use of a Pipeline Integrity Gauge (PIG) being forced through a pipe utilizing gas pressure to clean a crude oil pipeline. A section of pipe located between the receiver barrel and the isolation valve was not depressurized while employees were cleaning paraffin wax out of the receiver barrel while the receiver door was open. This condition exposed employees to struck-by hazards during pipe maintenance. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct these hazards during maintenance operations involving the use of a Pipeline Integrity Gauge (PIG) would be to follow ASME B31.8-2025 section 853.6 Pig Trap Maintenance. Under 853.6, subparagraph (a) Procedures shall be established for the isolation and depressurization of pig traps prior to opening. The procedures shall include personnel safety hazard assessments.

29 CFR 1910.147(d): The application of energy control (lockout or tagout) actions were not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): a) On September 18, 2025, and times prior, at 101st Valve Set, GPS 48.404333 N - 102.866472, near Tioga, ND 58852, the employer did not ensure the application and sequencing of steps involving lock out/ tag-out were implemented. Employees were exposed to struck by hazards resulting in serious injuries from the release of hazardous compressed gas and a high-velocity projectile while conducting maintenance operations involving the use of a Pipeline Integrity Gauge (PIG). The employer did not follow methods of control for [1910.147(d)(1)]; orderly shutdown [1910.147(d)(2)]; locating/operating energy isolating devices [1910.147(d)(3)]; lock-out/tag-out device application [1910.147(d)(4)]; dissipation of residual energy [1910.147(d)(5)]; and verification of isolation [1910.147(d)(6)] were not implemented prior to maintenance and service activities.
