29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  Location: 70 Port Street, Flanders, NY 11901  On or about 09/19/2025, an employee was installing ceiling joists for a single story residential home while working approximately 8ft above the ground floor below. The employee was not protected by a means of fall protection and was exposed to falling 8ft.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access.   Location: 70 Port Street, Flanders, NY 11901  On or about 09/19/2025, an employee accessed the first floor ceiling joists of a residential home by using a aluminum extension ladder that was not extended above the landing.   Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
