29 CFR  1910.28(b)(15): Walking-working surfaces not otherwise addressed. Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walking working surface 4 feet (1.2 m) or more above a lower level is protected from falling by one of the systems listed in 1910.28(b)(15)(i)-(iii):  a) On or about September 20, 2025, and at times prior, the employer did not ensure employees were protected from fall hazards in excess of 50 feet from a cliff to the ground below, while performing rappelling operations   on the Mount Blue Sky Via Ferrata course. This condition exposed an employee to fatal injuries after falling approximately 50 feet when attempting to rappel down a cliff face.

29 CFR  1910.30(a)(3): The employer did not train each employee in at least the following topics listed in 1910.30(a)(3)(i)-(iv):  a) On or about September 20, 2025, and at times prior, the employer did not ensure employees were protected from fall hazards in excess 50 feet to the ground below while performing rappelling operations on the Mount Blue Sky Via Ferrata course, without being trained on how to recognize fall hazards in the work area, procedures on how to minimize those hazards and procedures for proper use of protective systems. This condition exposed an employee to fatal injuries after falling approximately 50 feet while attempting to rappel down a cliff face.
