29 CFR  1926.55(a)(2): An employee(s) was exposed to substance(s) with a permissible exposure limit not preceded by (C) at concentrations above that specified in Table 1 of �1926.55 for that substance(s):   a) At the jobsite located at 1 Tampa General Circle, Tampa, Florida 33606: On or about September 19, 2025, an employee working in a permit confined space was exposed to 229.1 ppm of carbon monoxide (CO) over a 180-minute period, based on carboxyhemoglobin level in the employee's blood.  This is equivalent to an 8-hour TWA exposure of 85.9 ppm, which represents 1.72 times the OSHA-PEL of 50 ppm.

29 CFR  1926.353(b)(1): General mechanical or local exhaust ventilation meeting the requirements of paragraph (a) of 29 CFR 1926.353 was not provided where welding, cutting, or heating was performed in a confined space:   a) At the jobsite located at 1 Tampa General Circle, Tampa, Florida 33606: On or about September 19, 2025, an employee working in a permit confined space such as a storm drain and while cutting concrete with a TS 700 Gasoline Cut-Off Machine was exposed to 229.1 ppm of carbon monoxide (CO) over a 180-minute period, based on carboxyhemoglobin level in the employee's blood.  This is equivalent to an 8-hour TWA exposure of 85.9 ppm, which represents 1.72 times the OSHA-PEL of 50 ppm.

29 CFR  1926.1203(a): Before work begins, the employer did not ensure that a competent person identifies all confined spaces in which one or more of the employees are to enter and evaluates any permit required confined spaces.  a) On or about September 19, 2025, at the site located at 1 Tampa General Circle, Tampa, Florida 33606, the employer failed to properly identify a storm drain as a permit required confined space and did not ensure that employees entering the drain to cut concrete pipe with a TS 700 Gasoline Cut-Off Machine followed permit required confine space entry procedures or completed a certification for reclassification of the space prior entering the storm drain.

29 CFR  1926.1203(e)(2)(vi): The employer did not continuously monitor the atmosphere of the Permit-Required Confined Space and did not demonstrate that equipment for continuous monitoring was not commercially available or periodic monitoring was sufficient:  a) At the jobsite located at 1 Tampa General Circle, Tampa, Florida 33606: On or about September 19, 2025, the employer did not ensure that continuously atmospheric monitor was conducted while employees were working in a permit confined space such as a storm drain and while cutting concrete with a TS 700 Gasoline Cut-Off Machine.  The employee was exposed to 229.1 ppm of carbon monoxide (CO) over a 180-minute period, based on carboxyhemoglobin level in the employee's blood.  This is equivalent to an 8-hour TWA exposure of 85.9 ppm, which represents 1.72 times the OSHA-PEL of 50 ppm.
