On or about September 29, 2025, Haddad Plumbing & Heating, Inc., failed to ensure employees that were engaged in the installation of a water service line from a trench that was approximately 7 feet were protected from cave-in by adequate protective system.

29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: Site: 235 Prospect Ave, West Orange, NJ 07052. 1). On or about September 29, 2025, Haddad Plumbing & Heating, Inc. did not ensure an employee who was engaged in the excavation of a trench using a 304E2 CR Hydraulic Excavator was trained to recognize and avoid unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury. Employees are exposed to struck-by and crushing injuries.
