29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Worksite, 19 Clinton Ave, Albany, NY 12207, fire escape - an employee was climbing on the guardrail of a SJ8841 SkyJack scissor lift to access the landing tread of the fire escape approximately 30-feet above the ground. The employee was not instructed in the recognition and avoidance of unsafe fall hazards.

29 CFR  1926.303(b)(1): Grinding machines were not equipped with safety guards in conformance with the requirements of ANSI B7.1-1970, Safety Code for the Use, Care, and Protection of abrasive wheels, and paragraph (d) of this section:   a) Worksite, 19 Clinton Ave, Albany, NY 12207, fire escape - On or about October 1, 2025, an employee was operating a Dewalt 4 1/2in Angle Grinder Type 15A - with a PFX #80138 Grinding Wheel mounted on the spindle to clean paint and rust from the fire escape stairs that did not have a guard.

29 CFR  1926.404(b)(1)(iii)(C): Where an assured equipment grounding conductor program was being utilized, the employer did not ensure that each cord set, attachment cap, plug and receptacle of cord sets, and any equipment connected by cord and plug, except cord sets and receptacles which are fixed and not exposed to damage, were visually inspected before each day's use for external defects, such as deformed or missing pins or insulation damage, and for indications of possible internal damage:  a) Worksite, 19 Clinton Ave, Albany, NY 12207, fire escape - On or about October 1, 2025, an employee was operating a Dewalt 4 1/2in Angle Grinder Model No. DWE402 Type 15A - with a PFX #80138 Grinding Wheel mounted on the spindle to clean paint and rust from the fire escape stairs and the sheath of the power cord was cut and damaged.

29 CFR  1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:  a) Worksite, 19 Clinton Ave, Albany, NY 12207, fire escape - On or about October 1, 2025, an employee was operating a Dewalt 4 1/2in Angle Grinder  Model No. DWE402 Type 15A - with a PFX #80138 Grinding Wheel mounted on the spindle to clean paint and rust from the fire escape stairs and was exposed to electrical shock hazards. The  flexible cord had exposed wires and did not have strain relief.
