29 CFR  1910.1200(e)(1):Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):  On or about October 3rd, 2025, employees engaged in concrete pouring operations located at 1701 West Pleasant Hill Road, Lincoln, Nebraska 68523, were exposed to corrosion and irritation hazards in that employees were pouring and forming concrete on a residential structure with the intent of remodeling an existing front porch. The employer failed to develop and implement a required HAZCOM program prior to work commencing.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  On or about October 3rd, 2025, employees engaged in concrete operations located at 1701 West Pleasant Hill Road, Lincoln, Nebraska 68523, were exposed to corrosion and irritation hazards in that employees were handling and using concrete when pouring footings and building a retaining wall in the front entrance area of the residential structure.  The employer failed to provide effective training to employees on the hazards associated with handling and using concrete.

On or about October 3rd, 2025, employees engaged in concrete operations located at 1701 West Pleasant Hill Road, Lincoln, Nebraska 68523, were exposed to corrosion and irritation hazards in that employees were pouring and forming concrete and the employer failed to provide employees with immediate access to SDS sheets on the job site.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  On or about October 3rd, 2025, employees engaged in demolition operations located 1701 West Pleasant Hill Road, Lincoln, Nebraska 68523, were exposed to struck-by hazards in that the employer failed to provide adequate training to employees on how to safely remove an existing brick wall.  As a result, an employee was fatally struct by a brick wall that partially collapsed.

29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about October 3rd, 2025, employees engaged in demolition operations located at 1710 West Pleasant Hill Road, Lincoln, Nebraska 68523, were exposed to struck-by hazards in that employees were removing an existing brick wall with a sledge hammer.  The employees performing this work were not equipped with protective helmets and were subject to falling debris when removing the brick.  As a result, the brick wall partially collapsed and struct an employee in the head causing a  fatal injury to the employee.

29 CFR  1926.701(b):All protruding reinforcing steel, onto and/or into which employees could fall, was not guarded to eliminate the hazard of impalement:  On or about October 3rd, 2025, employees engaged in demolition operations located at 1701 West Pleasant Hill Road, Lincoln, Nebraska 68523, were exposed to impalement hazards in that two steel rebar rods were protruding  2-4 inches in the upright position from a newly formed retaining wall.  Employees were stepping over the retaining wall in order to perform work demolition work on the walls.  The rebar was not equipped with  protective caps.
