OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  At 6540 Dr. Martin Luther King Drive, St Louis, MO, 63133, On October 3, 2025 employees were exposed to crushing hazards during the dumpster loading process.  An employee stood between an open top dumpster and a semi-trailer while an equipment operator attempted to hoist the dumpster onto a HINO 338 tilt frame medium duty truck.  The employee suffered fatal injuries when the dumpster pinned and crushed him against the semi-trailer.

29 CFR  1910.28(b)(1)(i):Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  At 6540 Dr. Martin Luther King Drive, St Louis, MO, 63133, On October 3, 2025 employees were exposed to fall hazards while working on a platform area greater than four feet below a lower level without being protected by one or more of the systems described in 1910.28(b)(1)(i).    Employees working at a weigh scale station for small scrap are exposed to an unguarded platform which is approximately 4.1 feet above a lower level.

29 CFR 1910.28(b)(11)(ii): The employer did not ensure that each flight of stairs having at least 3 treads and at least 4 risers is equipped with stair rail systems and handrails as described in 29 CFR 1910.28 Table D-2-Stairway Handrail Requirements.  At 6540 Dr. Martin Luther King Drive, St Louis, MO, 63133, On October 3, 2025 and at times prior thereto employees were exposed to falls from an unprotected side of a flight of stairs without a stair rail system.

At 6540 Dr. Martin Luther King Drive, St Louis, MO, 63133, On October 3, 2025 and at times prior thereto employees were exposed to falls from an unprotected stair rail system that exceeded the 19 inch requirement by having no mid rail.

At 6540 Dr. Martin Luther King Drive, St. Louis, MO, 63133, On October 3, 2025 employees were exposed to electrical hazards associated with damage to conduit and junction boxes of a 120 V branch circuit which lead to a Marathon V6330 baler.  Parts at the top of the baler were also damaged.
