29 CFR 1926.651(j)(2):Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary. On or about October 8, 2025, employees engaged in residential plumbing and excavating activities at the jobsite located at 7311 N. 80th Street, Omaha, Nebraska were exposed to struck-by, caught between and trench collapse hazards in that the employer failed to ensure the spoil pile was at least 2-feet away from the edge of the trench. In this instance, the CSHO documented that the employer had the spoil pile on the north side of the trench. The distance from the edge varied with much of the spoil near the access ladder being directly on the edge.

29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data shall be in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer. On or about October 8, 2025, employees engaged in residential plumbing and excavating activities at the jobsite located at 7311 N. 80th Street, Omaha, Nebraska were exposed to caught between and trench collapse hazards in that the employer installed 22-36 inch aluminum shoring to serve as cave-in protection without meeting the requirements of the tabulated data for the product. Tabulated data requires the maximum distance between aluminum speed shoring to be between 4 to 8-feet. In this instance the CSHO documented the employer has shoring set up 15-feet apart.

29 CFR 1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: On or about October 8, 2025, employees engaged in residential plumbing and excavating activities at the jobsite located at 7311 N. 80th Street, Omaha, Nebraska were exposed to fall hazards in that the employer failed to ensure the portable aluminum extension ladder set up as means of access and egress from the trench extended at least 3-feet over the upper landing surface so as to provide employees with support during use.
