Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by/caught in-between hazards: A) Borealis Compounds Inc.-176 Thomas Road, Port Murray NJ 07865 On or about 10/10/2025, a Switch Crew was assigned the task of switching a plastic pellet hopper car using a Trackmobile Mobile Railcar Mover in the facility's rail yard were exposed to struck-by/caught in-between hazards. While performing the task the Engineer was sitting inside the cab of the Trackmobile and the Switchman was standing on the tracks at the rear of the railcar releasing the air brakes when the Engineer moved the hopper car causing it to strike the Switchman. The employee's arm was struck by/caught in the wheels of the railcar and resulted in serious injuries because of the incident. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN ADDITIONAL PENALTY OF $1000.00 AS PER CFR 1903.19.
