29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazards present: Three Corners Solar Field - Employer failed to ensure employees used the proper face protection, as listed in their hazard assessment and live electrical work permit, when they negated need for face shield due to low arc hazard but did not further assess possible other hazards that shield was being used to protect employees from, resulting in an serious cross body electrical shock by entry through an employee's right cheek and exit out the left employee's hand.

29 CFR 1910.269(l)(3)(iii): The employer did not ensure that no employee approaches or takes any conductive object closer to exposed energized parts than the employer's established minimum approach distance, unless: [A] The employee is insulated from the energized part (rubber insulating gloves or rubber insulating gloves and sleeves worn in accordance with paragraph (l)(4) of this section constitutes insulation of the employee from the energized part upon which the employee is working provided that the employee has control of the part in a manner sufficient to prevent exposure to uninsulated portions of the employee's body), or [B] The energized part is insulated from the employee and from any other conductive object at a different potential, or [C] The employee is insulated from any other exposed conductive object in accordance with the requirements for live-line bare hand work in paragraph (q)(3) of this section: Three Corners Solar Field - Employer failed to ensure that employees were at least 1 inch from energized parts between 301 and 5,000 volts when replacing solar modules (panels) as an employee contacted an MC4 connector with their cheek and sustained a cross body electric shock rendering the employee briefly unconscious and requiring hospitalization.
